WARRANTY TERMS

Thank you for choosing Tuff Buildz for your computer purchase.

We want you to have a satisfying experience with our products, and we stand behind the quality of our merchandise.

Please read the following warranty terms carefully to understand your rights and obligations.

Tuff Buildz PC Limited, trading as "Tuff Buildz" hereby warrants their new computer systems and related products with a limited 2 year manufacturer warranty from the date of purchase, to the "Purchaser" subject to all the terms and conditions as specified herein. Tuff Buildz sole obligation under this warranty is to repair or replace, free of charge, any defective components in their purchaser's computer system within the limited warranty period.

The warranty period and coverage details vary depending on the specific product and manufacturer. Please refer to the product description or documentation provided with your purchase for warranty information.

This warranty is only valid if the product:
 

  1. Was installed per Tuff Buildz instructions;
     

  2. Was not damaged by the purchaser's software or hardware, including software or hardware incompatibility;
     

  3. Was not damaged due to misuse, overclocking, poor environmental conditions, or physical damage (such as having the computer setup in a damp garage where the computer components become rusted);
     

  4. Was operated under normal conditions of use in accordance to the respective manufacturer specifications;
     

  5. Was serviced once per eighteen months with the removal of any built-up dust inside the computer and on the computer components (desktops only);
     

  6. Had been supplied by Tuff Buildz and has not been altered by the purchaser in a way that could impact the system's ability to operate as per the original requirements;
     

  7. Is presented with the original invoice number / order number so Tuff Buildz can match the warranty documentation for the products.

 


This warranty shall not apply to product(s) that have been used to a degree outside of normal manufacturer intended use, which shall include but is not limited to "MINING" operations, for example data, cryptocurrency, data mining and farm mining.

Any modification made to the Product must be reversed prior to shipment back to Tuff Buildz for warranty service. Product must be in original condition to receive warranty service.

THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR TITLE AGAINST INFRINGEMENT, WHICH OTHER WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED. TUFF BUILDZ SHALL NOT BE LIABLE FOR LOSS OF PROFITS OR ANY SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES WHICH PURCHASER OR THIRD PARTY MAY SUSTAIN, EVEN IF TUFF BUILDZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES. IN NO EVENT SHALL TUFF BUILDZ LIABILITY EXCEED THE PURCHASE PRICE OF THE DEFECTIVE PRODUCT.

The purchaser acknowledges that the goods sold by Tuff Buildz are being used or incorporated into other products or systems, and the ultimate safety of those products or systems are the sole responsibility of Purchaser. Purchaser assumes all risks and liability of use of Tuff Buildz products in other products or systems. Purchaser agrees that it and/or its customers are solely responsible and agrees that the use of Tuff Buildz products for any purpose related to such services or otherwise cannot in any way be controlled by Tuff Buildz, and Purchaser or its customers are responsible for verifying the accuracy and completeness of any information contained in, entered into, or used in connection with Tuff Buildz products.

Purchaser assumes all risks and liability for use of Tuff Buildz products in other products or systems. Third party products and/or systems are including but not limited to motherboards and other system components are not covered by this warranty. In no event shall Tuff Buildz be liable for any damages of any kind sustained by Purchaser, any customer of Purchaser, or others for any suit or claim or demand arising from the use of Tuff Buildz products.

Warranty coverage requires proof of purchase documentation evidencing the date of purchase (sales receipt or invoice), place of purchase, purchase price, item number or ID, and original packaging and accessories. To obtain warranty service during the warranty period, contact the local reseller / distributor.

Return freight costs may, at Tuff Buildz sole discretion, be the responsibility of the purchaser if the returned product is deemed to not be covered under Tuff Buildz limited warranty.

Return to purchaser freight costs for repaired or replacement products will be covered by Tuff Buildz for one year starting from the original purchase date. Repaired or replacement products will be shipped via a selected Courier.

Purchaser pays for shipping product to Tuff Buildz for the second year of warranty. Customer assumes the risk of loss (insurance from loss or damage) in transit and the returned Products shall become the sole property of Tuff Buildz. Tuff Buildz warrants that the repaired or replaced Products will be free from defects in material or workmanship for the remainder of the original product’s warranty term.

Determination of damage or defect, as a result of any modifications, misuse or overclocking by purchaser, will be at the sole discretion of Tuff Buildz. Any repair charges arising due to any modification the purchaser has made, will be the sole responsibility of the purchaser.

Tuff Buildz reserves the right to inspect and verify the defectiveness of any product returned for warranty.

Tuff Buildz reserves the right to change the terms and conditions of this policy without advance notice.

Manufacturer’s Warranty
The manufacturer’s warranty covers defects in materials and workmanship under normal use for the duration specified by the manufacturer.

This warranty is valid only for the original purchaser and is non-transferable.

Manufacturer Warranty Claims
If you believe your product is defective and covered under the manufacturer’s warranty, please contact us immediately at tuffbuildz@gmail.com to initiate a warranty claim.

We may require proof of purchase and additional information about the nature of the defect.

Warranty Exclusions
The manufacturer’s warranty does not cover damage resulting from:

  • Accidental damage, misuse, or abuse

  • Improper installation or maintenance

  • Unauthorized modifications or repairs

  • Normal wear and tear

  • Acts of nature, such as lightning, floods, or earthquakes

  • Use of the product for purposes other than those intended by the manufacturer


Warranty Remedies
If a product is found to be defective and covered under the manufacturer’s warranty, we will work with the manufacturer to repair or replace the product, or issue a refund, at our discretion. The method of remedy will depend on the manufacturer’s warranty policy and the circumstances of the warranty claim.

Limitation of Liability
To the extent permitted by law, www.tuffbuildz.com shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or performance of any product sold on our website, including but not limited to damages for lost profits, loss of data, or loss of use.

Additional Rights
These warranty terms do not affect your statutory rights as a consumer under the Consumer Guarantees Act 1993 and other applicable consumer protection laws in New Zealand.
